INTRODUCTION

Cryptix and its group companies and affiliates (hereinafter – “Cryptix” or “we”) understand that you are aware of and care about your personal data protection, and we take that seriously. Personal Information and Personal Data are terms used in this Privacy Policy, both of which refer to any information relating to an identified or identifiable individual. This Privacy Policy forms an integral part of the Cryptix T&C and describes policies and practices regarding our collection and use of your personal data, as well as sets forth your privacy rights. We recognise that personal data protection is an ongoing responsibility, and we may from time to time update this Privacy Policy, as we undertake new personal data processing practices.

“You” in this Privacy Policy refers to a user of our Services (hereinafter – “User”).

We will not file the Privacy Policy with you so please print it out or save it for your records along with all emails, additional terms and policies relevant to your use of the Services.

INFORMATION WE MAY COLLECT AND PROCESS

Your personal data, including, but not limited to, e-mail address, details of your Cryptocurrency Address and Cryptocurrency Return Address, and your IP address, logs of the process of the use of our Services by you;
Information and documentation that you may provide to us upon request in relation to any checks conducted or otherwise in accordance with the T&C. Such information may include, but is not limited to, your name, surname, date of birth, address, country, telephone number, passport or ID data, Cryptocurrency Return Address;
A record of correspondence/communication and/or the telephone call in the event you contact us or visit us. Such record may include your name, surname, e-mail address, telephone number, CCTV and access control data, as well as other personal data you may disclose to us during such communication;
Information about you, which we may receive from other sources, including, but not limited to, Merchants, our business partners, service providers and subcontractors.

Other data:

We may also collect non-personal information about you, which does not identify you as a specific individual. Such non-personal information that we may collect includes:

Browser and device data, for instance, IP address, operating system and browser type and browsing actions. This is statistical data about the Service application users;
Cookie data, such as time spent on the Service application, pages visited, language preferences, and other anonymous traffic data;

HOW WE USE PERSONAL DATA

We use your personal data to enable you to use our Services. In this regard, we rely on a contract entered into by you and Cryptix as the valid ground for the processing of your personal data and on the legitimate interests pursued by us.

Examples of how we may use your personal data include:

to notify you about changes to our Services;
to respond to your enquiries and provide customer support;
to maintain internal recordkeeping;
to conduct know your customer, fraud and other checks, including by way of receipt of relevant personal data from the Merchant;
to transfer your e-mail, IP address, Cryptocurrency Address and Cryptocurrency Return Address data to our Service Providers involved in the provision of our Services and for conducting know your customer, fraud and other checks by them;
to transfer your personal data, including transaction and other data to the Merchant;
to enforce our legal rights and comply with our legal obligations arising from the applicable law and a contract entered into between you and us.

HOW LONG WE WILL KEEP YOUR PERSONAL DATA

We will store your personal data for the period necessary to fulfil the purposes listed above, unless a longer retention period is required or permitted by law. Please be aware that we may be required to retain your personal data for various legal or regulatory reasons, for example, to investigate any potential fraud and to ensure adherence to know your customer requirements. In addition, retention periods for different personal data categories may vary, depending on our obligations. This means that in the event where you cease to use our Services, we may still retain certain personal data for up to 7 years in order to carry out our obligations.

USE OF SERVICES BY MINORS

The Services we provide are not directed to persons under the age of 18 (eighteen) and we kindly ask such persons to not disclose their personal data to us.

HOW WE DISCLOSE PERSONAL DATA

In certain circumstances we may, directly or indirectly, disclose the personal data we have gathered about you to the following categories of recipients:

Our group companies. In order to provide our Services, we share personal data with our group companies. Cryptix is the entity responsible for the general use of personal data by other group companies in relation to the Services provided by Cryptix;
Merchants. These are Merchants who you contract with for the purchase of their goods or services;
Service Providers. We disclose personal data to Service Providers to the extent necessary to ensure the provision of our Services
Third-parties in relation to transfer of business. For instance, if we sell any business or assets or merge with another business entity, it may be necessary to disclose personal data to the prospective business owners or partners;
Third-parties in relation to a legal obligation or if we are permitted to do so by law. In certain circumstances we may be under an obligation to disclose or share your personal data with auditors or law enforcement bodies in order to comply with a legal obligation. We may also disclose personal data, if it is permitted by law, in order to enforce or apply the T&C or to protect our rights, property, customers or others

Your personal data may be transferred to and processed at a destination outside the European Economic Area (hereinafter – “EEA”). Where such transfers of personal data take place, we have concluded either Standard Contractual Clauses or other appropriate safeguards, in order to ensure that your personal data is treated in a secure manner and in line with this Privacy Policy.

YOUR RIGHTS

You have certain rights in respect to the way we treat your personal data:

You are entitled to access your personal data and receive information regarding your personal data that we process;
You are entitled to rectify the information we have about you if it is inaccurate;
You are entitled to object to the processing of your personal data;
You have the right to revoke your consent for processing of your personal data if such consent has been given by you where applicable. We will inform you (before collecting your data) if we intend to use your data for such purposes or if we intend to disclose your information to any third party for such purposes;
You may also request us to erase your personal data or cease the processing of your personal data. However, please note that this right may be subject to certain exemptions. Namely, in situations, where we are under a legal obligation to retain your personal data, we will not be able to fulfil your request and, in such an event, we will inform you accordingly;
You may also request us to provide your personal data to you or transmit it directly to another controller and we will comply with such request, provided that the personal data processing previously carried out by us was based on your consent or was necessary for the performance of a contract and where it is technically feasible;
